Defiant Jubilee Party unveils Isaac Mwaura's replacement in the Senate despite court order

Jubilee party has unveiled Sammy Prisa Leshore to replace former Nominated Senator Isaac Mwaura to represent persons living with disabilities in the Senate.

The announcement was made despite an interim court order that was issued on Tuesday evening against Mwaura’s removal from the Senate.

The Milimani High Court had directed that the respondents be restrained from implementing or further acting on the judgment of the Political Parties Tribunal pending hearing and determination of the motion.
Consequently, the motion dated May 11, 2021 is fixed for interpartes hearing on May 24, 2021,” Justice Joseph Sergon said.
Additionally, the judge issued an order for stay of further implementation of the Gazette Notice number 4597 Vol CXX11-102 dated and issued on May 10 by the third respondent.

Mwaura has been accused by his party for being disloyal to the which has since culminated to his expulsion.

This come after Jubilee Secretary General Raphael Tuju on February 8, 2021 stated that the National Management Committee (NMC) had met and deliberated on a report filed by the party’s disciplinary committee.

“The NMC in exercising its mandate provided or under article 7 (2a) of the party’s constitution and relying on other enabling provisions of the party law has expelled the following senators, ” Tuju said.
The Nominated Senators who were expelled by the Jubilee party include; Isaac Mwaura, Seneta Mary Yiane, Waqo Naomi Jilo, Omanga Millicent, Prengei Victor, Iman Dekow and Gona Christine Zawadi.

He further noted that the expulsion was immediate but noted that the legislators still reserve their right to make an appeal.

“The expulsions are with immediate effect and have been communicated to the Senate and the registrar of political parties,” Tuju said.

The Senate Speaker Kenneth Lusaka on May 11, 2021 through a gazette notice declared Mwaura’s seat vacant.
