    Bishop Thagana condemns on Shakahola Massacre

    Bishop David Munyiri Thagana is the Secretary General of the Federation of evangelical churches of Kenya. He is also the founder and Presiding bishop of Glory Outreach Assembly. He shares with us his thoughts pertaining the shocking events of massacre in Malindi.

    “We need to have the conversation because the things we are seeing now are not new to us. Only the magnitude is much higher. One of the things we as Kenyans we are very reactive instead of being proactive.

    If we were more proactive in looking at things before they happen, we could save a lot of lives.

    I want us to go beyond the conversation and go beyond the system and structures. Not just religion but we have other agencies .

    About regulation this is an overdue.

    The question has been how. And not just churches or religious organizations.

    Accountability structure. If someone deviates then you have a redress mechanism. I guess our major concern as churches is for us to be regulated by the government .

    Some of them may not draw the line between regulation and curtailing the freedom of worship. The church should clearly be heard championing self regulation under their umbrella.

    “in my view there is corporate blame starting with the whole system of internal security all the way from nyumba kumi, to the chief to the entire system..parents are to blame. The church is to blame

    But above all, the government is the one that should be taking care of all of us.”

    Justice and Legal Affairs Committee engaged Legislators proposing various amendments on different Bills

     

    The Justice and Legal Affairs Committee led by its Chairperson Hon. George Gitonga Murugara held meetings with different Legislators proposing various amendments on different Bills.

    Hon. Simon King’ara of Ruiru, the proposer amendments on the Law of Contract Act, Cap. 23; to provide that incase of a default of a certain financial obligation, the plaintiff should first realize the assets of the defaulter before attaching the assets of a guarantor.

    The proposal is intended to protect the guarantors against the claims that arise following default on financial obligations by the principal. This Bill had been passed by the House during the 12th Parliament but was referred back by the President.

    The Chairperson of the committee commended the legislator for the proposals noting that they will help caution guarantors, and promised to further deliberate on them with the committee members.

    “We need to look into some sort of exhaustive remedies against the principal borrower and we also have something on security, exhausting on items to recover that are stated by the principal lender. The committee will look at it considering all the reservations and address them conclusively.” Said Hon. Murugara.

    Hon. Francis Masara, (Suna West) appeared before the committee with amendment proposals for the Marriage (Amendment) Bill, 2022. The principal aim of this Bill is to amend the Marriage Act, 2014; by introducing Clause 2 of the Bill to amend section 2 of the Act by inserting a new definition of the term “mutual separation”.

    The proposal also seeks to introduce clause 3 of the Bill by inserting a new section 75(A) into the Act, to provide that parties in a marriage may jointly petition the court for decree of divorce by mutual consent if the marriage has irretrievably broken down, the parties have mutually separated for atleast one year immediately preceding the date of presentation of the petition and also if the parties have mutually agreed to dissolve the marriage.

    “The current process will remain intact. But the only difference is, in the current process, only one party goes to court. But in most instances when people are divorcing, none of us wants to make the first move. But in this one, I want to introduce the process; how do we initiate it. The only cure I want to make is for the two to initiate the entire process which will go as per the current law.” Stated Hon. Masara.

    The committee also heard from Hon. Julius Sunkuli (Kilgoris) who has a proposal for the National Coroners Service (Amendment) Bill, 2023; that seeks to amend the National Coroners Act, 2017; to have a Coroner-General, who should be a legal practitioner on account of the complexity and the technical nature of the role which requires them to make recommendations on the legal and policy interventions in accordance with standards and practice.

    Further, the proposal re-designates the office of the Coroner-General and the National Coroners Service from the Public Service Commission to the Judicial Service Commission. The legislator also noted that the Attorney General has never been categorized as a Cabinet Secretary and therefore proposed deletion of the term Cabinet Secretary and insertion of the word ‘Commission’, to mean the Judicial Service Commission.

    On the qualifications, the legislator proposes an alteration of the qualification of a Coroner-General from a medical practitioner to an Advocate of the High Court of Kenya with atleast 10 years experience.

    Hon. Sunkuli noted that this office will help to thoroughly and independently investigate the extra judicial killings happening in the country, especially the current mysterious killings of people in Shakahola, Kilifi County.

    The sessional Chair Hon. John Kaguchia (Mukurwe-ini) agreed that there are many things that have come into question with this Bill, and that it needs to be looked into comprehensively.

    The committee lastly heard from Hon. David Gikaria (Nakuru East) regarding the Penal Code (Amendment) Bill (National Assembly Bill No. 56 of 2022). The legislator proposes to amend the Penal Code, Cap. 63, by repealing section 182 which provides for offences relating to idle and disorderly persons.

    Hon. Gikaria argued that the provision has been abused by law enforcement agencies to harass innocent members of the public and that it limits the right to freedom of movement and association.

    “We need to mop up these colonial laws which are in our constitution. You find the arrests for some minor offences are blown up using section 182 and exorbitant penalty charges instigated on the accused.”

    The Murugara-led committee will be conducting an in-depth analysis on the proposals while considering the current laws, the loopholes and the resultant implications of the amendments.

    As life is a circle,  majority have chosen to take it in different angles as the writer can tell the story of Winjoy Kananu a youthful entrepreneur literally ventured in second hand clothes.

    The lady Winjoy started small. She didn’t despise her humble beginnings.

    The writer tells how she started selling eggs. After a while switched to selling fruits the power of hardwork paid off and she eventually started opening bales.

    In an interview, she alludes to the writer that her greatest driving factor is passion.

    She says,

    “It’s all about passion. When selling fresh things they can sometimes disappoint you due to their perishable nature. But the moment you sell clothes it’s so fulfilling.”

    Kananu says that passion is all the drive to success as it remains the true pillar.

    “In business it’s all about passion. Do something that can motivate you so that by doing so you can become your Chief Encourager Officer.”

    She sources her second hand clothes from the United Kingdom.

    The writer tells that Kananu advises the youths to step out and do so with faith. It’s all about ”kujituma.” Start small. Give it your all and finally you shall succeed.

    Winjoy delivers her clothes to her clients locally and even across borders serving clients in South Sudan, Nigeria Tanzania and South Africa.

    “The African Market is magnanimous. That’s why I’m currently looking into means of transportation to deliver to them.” Kananu notes.

    Kananu has however stood her ground to advise those wishing to pioneer in these business to avoid giving up.

    “Don’t give up. Being your own Boss is the greatest feeling, you manage yourself observe Self Discipline and in business never quit. Stay focused and give your business at least One year to break even. Let Passion be always your driving factor.” She concluded.

    With various dramas and shenanigans surrounding the liberty of religious institutions, various Men and Women of God have come out to air their views.

    According to Miriam Mukami Maina who ministers with the body of Christ United International Global Ministries, she notes that the religious body should be allowed to self regulate citing the independence of other religions such as Islam.

    This follows shocking revelations of a preacher in Shakahola, Malindi in Kilifi County who lured his congregants to death by starvation through fasting.

    At the moment the DCI is trying to unravel the mystery behind the massacre.

    The African Women Leaders’ Network (AWLN) appeals to the parties to the conflict in Sudan, to disengage immediately to end the tragic loss of lives, particularly of women and children.

    The parties have urged them the importance of the dialogue.

    “We urge them to return to a dialogue which will result in an end to the peace and humanitarian crisis, beginning with ensuring that civilians are afforded the protections guaranteed under international law and corridors of safety are created to allow further evacuations and distribution of urgently needed aid and assistance.”

    Through its Patron, Her Excellency Madam Ellen Johnson Sirleaf, AWLN joins the call of the Emergency Special Session on Sudan convened, on 20 April 2023, by Moussa Faki Mahamat, the Chairperson of the Africa Union Commission and the appeal of the United Nations Secretary-General, Antonio Guterres, for an immediate ceasefire, which will allow vulnerable populations to seek medical assistance, water, and food.

    The African Women Leaders’ Network (AWLN), is a mobilizing and convening platform and a transformative movement of African women, launched in 2017 by the African Union Commission and the United Nations. It mobilizes women across the continent, to address issues affecting the progress of the African Continent, and its women in particular.

    The Network aims to strengthen African women’s leadership in transforming the continent, in line with the African Union aspirations in Agenda 2063 and the United Nations 2030 Sustainable Development Goals. Prominent among its six pillars is the Women, Peace and Security Agenda, which advocates for the protection and talks of women in all peace processes, spearheaded by the AU Chairperson’ Special Envoy on Women, Peace, and Security.

    AWLN aligns itself with the principles enshrined in the UN and AU legal instruments on human rights, including UN Security Council Resolution 1325.

    AWLN wishes to appeal to the two parties for an immediate and durable ceasefire and a political settlement with the participation of women, a pre-requisite for a just and sustainable peace.

    Police from criminal investigation headquarters (DCI) have net 25 and half sacks of bhang with estimate street value of 4.5 million in mihango immaculate area arresting 4 suspects, the owner of the car, the worker and two drivers also with them police recovered 2 probox with fake number plates.

    The bhang was traced from migori to Nairobi Mihango Area where they found another consignment in the House where it was destined for supply.

    The OCPD Kayole, Mr Paul Wambugu while confirming the incident said the police were acting on a tip off and urged residents to continue to give information to the police in the fight againist narcotics.

    Mr Paul has urged the judiciary to join hands by giving strict term’s and bails while charging them in court .

    Present was the new OCPD Ruai Mrs. Patricia Yegon who urged Kenyans to join hands to figure narcotics to save a generation.

    Board members of Kenya Transport and safety authority NTSA has given its director general George Njau a compulsory leave of 30 days and appointed Cosmas Ngeso as the acting DG.

    Speaking during a press conference in Nairobi, the chairman of NTSA Aden Noor Ali said the action was taken so as to investigate some of the information they need to get until the board will decide otherwise.

    The board also said measures will be taken to restore safety and sanity of our roads including strictly enforcing the NTSA( operation of PSV) Regulations 2014 like requirement of a valid inspection for all vehicles, road service lincences for all vehicles, valid driving licences and PSV badges for all drivers and conductors

    Following public service and operators or saccos who have been involved infatilities in the last 30 days, their licences have been suspended with immediate effect such as Taita Taveta, Tahmeed sacco, Team Swat logistics & Management Limited, Kyoga Hauliers Kenya Limited.

    Dedan Kimathi Foundation (DKF) Nurtures Aberdare Forest

    The Dedan Kimathi Foundation under the wise leadership of the Chief Executive Officer Madam Evelyn Kimathi has embarked on a reafforestation program in the Aberdare Forest.

    Aberdare forest is historically important as it provided cover to Dedan Kimathi and other Mau Mau Freedom fighters in the 1950s as they engaged the British colonialists. It is a home to many bird species and wild animals besides waterfalls in it acting as major tourists attraction.

    In efforts to restore the forest to its former glory, Dedan Kimathi Foundation in partnership with Kenya Forest Service collaborated with Wanjerere Community Forest Association to plant 10,000 indigenous tree seedlings as the county launched the Long rains tree planting season running under the theme: “30% TREE COVER NI WAJIBU WETU” The 10, 000 tree seedlings were planted in Wanjerere and Kagongo Forest beats both in Wanjerere Forest Station that sits in Mathioya and Kangema sub counties of Murang’a. The planting was for rehabilitation of the 2 sites that the locals used to cultivate on under the PERIS program.
