  • Understanding The Plight Of Intersex

In our society, intersex has always had to face stigma as well as discrimination because of the misconceptions that are embedded in the minds of the community.

Despite the numerous awareness campaigns conducted by different groups such as the human rights defenders, this gender which is different from the normal male/female category, is still battling for their rights by the community.

One obvious thing is the fact that society is ignorant and therefore inclined to believe that intersexuality is an option, which is not the case.

Intersex or Disorders of Sex Development (DSDs), is a term used to describe a wide range of natural bodily variations.

An intersex person is born with any of the several variations in physical and sex characteristics such as those of the chromosomes, gonads, sex hormones, or genitals which do not fit the typical definitions for male (XY) or female (XX) bodies according to the United Nations Office of the High Commissioner for Human Rights.

In biology, Intersex is an organism that has physical characteristics intermediate between a true male and a true female of its species.

The condition usually results from extra chromosomes or a hormonal abnormality during embryological development.

Intersex traits in humans are usually visible at birth while in others, they are not obvious until puberty and, in a few cases, some chromosomal intersex variations may not be physically obvious at all.

A child may be born with ambiguous genitalia which is a condition in which an infant’s external genitals do not appear to be male or female. In a baby, the development of the genitals may be incomplete or he/she may have characteristics of both sexes, where the external sex organs may not match the genetic sex or internal sex organs.

According to the medical encyclopedia, there are various categories of intersex such as 46, XX; 46, XY; true gonadal intersex; and complex or undetermined intersex.

46, XX intersex has female chromosomes and ovaries but with external genitals that appear to be of a male. This person is most cases has a normal uterus and fallopian tubes.

It is said that there are many possible causes including exposure to excess male hormones before birth by a pregnant woman, male-hormone producing tumors most often ovarian tumors, aromatase deficiency which is an enzyme that converts male hormones to female hormones (aromatase), among others.

A person with 46, XY intersex category, also medically known as 46, XY undervirilisation, usually has chromosomes of a man but with external genitals that are incompletely formed, ambiguous, or female. He may have normal, malformed, or absent tests.

True gonadal intersex, is where a person has both ovarian and testicular tissue. The external genitals may be ambiguous or may appear female or male.

For years, Intersex persons have been living in isolation in a bid to avoid societal taunts. They have never enjoyed their rights as humans and instead have been violated.

A baseline survey on intersex realities in East Africa, 2015-2016 by the Support Initiative for People with Congenital Disorders (SIPD), shows that in Kenya, Uganda, and Rwanda, intersex children face many challenges as a result of superstition where they are believed to be witches or victims of witchcraft.

The adults face discrimination as well as physical and sexual harassment. They also suffer from a lack of adequate and affordable health care. The survey highlighted that 90% of the interviewed intersex teenagers were forced to drop out of school due to discrimination either by teachers or fellow students.

The baseline survey also indicated that with the birth of an intersex child, the community sees it as a punishment for the mother who is looked down on and may even be excluded from society.

In Kenya, the 2019 census revealed that there are a total of 1,524 intersex persons, though it is reported that the number could be higher but because of fear of the society, some parents opt to hide the truth about the gender of their children.

An official from Kenya National Commission on Human Rights (KNCHR), Western Region Office, Beryl Orao, says that the number of intersex persons in the country was not known before the 2019 survey.

“For the first time in Kenya, the intersex were accounted for during the 2019 census where we got to know how many they are in the country. The number could be higher but because of stigma, parents are usually reluctant to disclose the sex of their children,” she says.

Although Kenya has laws that recognize the existence of intersex people, they are not comprehensive enough to protect them.

They are still vulnerable to discrimination and stigmatization in school, sports, health, public services, and employment. These are the issues that Ms. Orao notes to be among the gaps in the system which the government is trying to fill.

“This particular group has faced a lot of challenges for a long time and have has been ignored not just by communities but also by government structures. They are not adequately catered for in our laws and systems like the scenario in birth registrations and official documents where there is no provision for the third gender,” Ms. Orao says.

Homa Bay County has 23 members of the intersex and just like the others, these individuals have not been spared by the community.

Having a one-on-one conversation with Homa Bay Town Location, Senior Chief Joshua Ochogo, says, “For years, the intersex have always seen the worst of our society. When born, an intersex child is associated with a curse and at times he or she is killed. Others are often hidden by the family because of fear of what the community might do or say.”

The Administrator further says that it is unfortunate that society blames the intersex person and his or her family for something which is beyond their control.

“The intersex and her or his family are always frowned at by the community when it is obvious that they had no control over their condition. We know that everybody wishes to have a normal child but when that does not happen then we become the laughing stock of the community who are ignorant,” he says.

Born and raised in Homa Bay, the 28-year-old Simon says he was identified as a male at birth but as he grew up the feminine part of him overpowered the maleness in him. Speaking to him, one gets the impression of a female trapped in the body of a male.

Dressed in unisex black trousers, a white official shirt, a coat, and a checked-black and grey cap, he comes out as a person who has endured all sorts of mistreatments in his life.

Listening to him complaining over the atrocities he has had to endure from the community members, especially after he lost his parents, one can only wonder how humans can be so inhumane.

He says that he has seen the worst of our society.

“After the death of my mother I was chased from home by my relatives to fend for myself. They said that I was a curse and would bring them misfortune. Even on her death bed, my mother was worried about me and my future,” he says.

He laments that he was shunned and maltreated by his relatives and the community.

“I have been violated, chased from my home, and had to sleep in the streets. At one point I was close to being killed, but I thank Trans-Alliance Kenya, who came to my aid at the time when I needed help the most. They took me to Kisumu to start a new life when life in Homa Bay became unbearable,” he notes.

He explains that he has problems with his hormones and experiences heavy menstrual periods and at one point was forced to seek medical help at a hospital.

He says that the experience he got from the health facility discouraged him.

“It was disheartening and embarrassing when I was taken for an ultrasound and the doctors kept calling others to come and witness what they were seeing. Such things discourage us from seeking medical help,” he says sadly.

One thing that he notes is that the medical practitioners in the country should be informed about their kind or rather, he explains that there should be doctors who are specialized to handle matters regarding intersex persons to avoid such inconveniences and embarrassing situations.

Separately, Gloria says she had a long journey of self-discovery, and today she feels more like a man and even wants to settle down and have a family.

However, she also notes that it is not easy to have a genuine partner as most of them enter into relationships with bad intentions.

“Having a genuine partner is not easy. Some may be in that relationship out of curiosity to know how we are structured and once they have witnessed, they start blackmailing us,” she says dejectedly.

One thing that comes out is the fact that intersexuality is different from transgender. It is not by choice but by birth and cannot be avoided whatsoever.

  • Roads get a face lift as Smart Towns initiative takes shape in Laikipia

The project aimed at upgrading ten urban centers across Laikipia County is proving to be a boon for the region, with properties now appreciating in value

The county government of Laikipia embarked on the Smart Towns Initiative program two years ago as part of the County’s Integrated Development Plan 2018-2022.

Among the eight towns that were selected for the project are Nanyuki, Rumuruti, Wiyumiririe, Kinamba, Ol Jabet, Naibor, DolDol, and Nyahururu.

Each Smart Town is characterized by a multi-disciplinary approach, all aimed at a safe, clean, functional Modern Township with commercial centers that serve the needs of its residents.

Current improvement of the road infrastructure to bitumen standards is seen as a game-changer that will not only create new investment opportunities but will also further open up the region.

The project has already started giving dividends to residents with the areas around the centers registering a rise in land prices.

At Ol Jabet trading center where the project is currently ongoing, for instance, many businesses have already started re-brandingrebranding and changing the look of the town that is located along the busy Nyahururu – Maralal Highway with land buying pitching camps in the area.

According to the project manager, Esther Mathenge the economic positive change is evident as the people embrace the new look.

Daniel Gachanja, the Ol Jabet business community chairman said the project has opened up the town and the neighboring villages where investors in eco-tourism lodges have been spotted since the start of the project.

He said that they were grateful and have already noted a change since the inception of the project.

Residents note that in the past few months, the price of land has been appreciating following the demand by the people interested to set up business ventures especially tourist hotels and lodges.

Agnes Kariuki, a resident, said the construction of the project which is now at the end of its first phase has opened up opportunities to hundreds of enterprising women and youth.

She said the town has a great potential for development but its growth has always been hindered by a lack of reliable transport infrastructure and poor planning.
Isaac Kuria, a Bodaboda operator, praised the project as a game-changer for their area, saying vast high potential regions had been cut off due to poor road network.

  • President Kenyatta Commends Progress Of Nairobi Expressway

President Uhuru Kenyatta on Thursday made an extensive inspection tour of the 27.1-kilometer Nairobi Expressway during which he expressed satisfaction with the progress of the key road.

When complete in March next year, the 8-lane elevated dual carriageway is expected to significantly decongest Mombasa Road and reduce travel time between Mlolongo and Westlands to 20 minutes.

During the inspection visit, President Kenyatta, who was accompanied by Infrastructure CS James Macharia and Nairobi Metropolitan Services (NMS) Director-General Mohamed Badi, laid the final box girder bridge, a year after the first was laid on 26th December 2020.

“It is a proud moment for us as Kenyans as we are here today witnessing the laying of the last of these girders that are linking this new superhighway, the Nairobi Express Way,” the President said.

The Head of State commended the contractor for a job well done and expressed confidence that the road will be ready for use by March next year.

“I want to thank the contractors because we started this project exactly almost to date one year ago when we laid the first box girder and today, almost to the date, three days earlier to one year, we are now laying the last.

“I am confident with the kind of speed that they are moving at, the indicated date of March for completion of this road is bound to be met. I will be very proud to be able to drive from Machakos turn-off to Rironi and hopefully, at that point, launch the road from Rironi to Mau Summit,” the President said.

Constructed under a Public-Private Partnership (PPP), the President affirmed Kenya’s commitment to continue working with the Chinese Government which he said continues to be Kenya’s key development partner.

“Our partnership with China is mutually beneficial, that is based on win-win, and we are very grateful to the Chinese Government and people for the support that they continue to render not only our country but to the rest of Africa,” President Kenyatta said.

President Kenyatta said the expressway had created over 6,000 direct jobs, benefitted 200 sub-contractors and hundreds of other local suppliers of building materials such as steel, sand, cement, and ballast.

“I want to thank everybody, the Ministry, the contractor, the Chinese Government, security agencies who have ensured that people can work on a 24-hour basis, NMS, and all those who have been involved,” President Kenyatta said.

The Head of State observed that the expressway was among the many ongoing road construction projects in Nairobi totaling over 420 kilometers.

“The difference that has been occasioned by road building, drainage and sewage being put in, I do believe that within another two years Nairobi will be a truly 21st Century city, catering for its population in a positive manner and a manner befitting our people,” the President noted.

On his part Infrastructure, CS James Macharia thanked the President for championing the project saying its completion will significantly decongest Mombasa Road.

“We thank you for the support because this project will make a very big difference for our country. After it is finished in March, people will be taking 20 minutes only from the airport to James Gichuru Road,” CS Macharia said.

He said the expressway is just one of several Nairobi link roads lined up noting that a similar project to connect Mlolongo to the Machakos turn-off, a distance of 20 kilometers, was underway.

“After we finish this project, James Gichuru 27 kilometers, there are another 25 kilometers to Rironi,” CS Macharia said.

  • Stop early celebrations MIGUNA MIGUNA warns RAILA ahead of 2022 polls

Friday, December 24, 2021 – Embattled Lawyer Miguna Miguna has warned ODM Leader Raila Odinga and his team not to celebrate ahead of the 2022 elections.

This is after it emerged that Raila has more MPs than his fierce rival, Deputy President William Ruto, as was witnessed during the first and Second reading of the controversial Political Parties (Amendment) Bill 2021.

The Bill saw William Ruto’s lieutenants, who have often claimed they have more numbers in the bicameral parliament than both President Uhuru Kenyatta and Raila Odinga, easily outnumbered; a move that left the handshake team in early celebrations.

But venting yesterday, the exiled lawyer urged Raila and his team to forget about the presidency.

He cited 2002 and 2007 when presidential hopefuls who had more numbers of MPs supporting their candidature lost, stating that a similar scenario is more likely to play out in the 2022 elections.

According to him, the then KANU presidential candidate Uhuru Kenyatta who the late President Daniel Moi threw weight behind his candidature, had more MPs than retired President Mwai Kibaki of PNU.

However, Kibaki with little support from MPs trounced Uhuru Kenyatta with a landslide to succeed Daniel Moi, who had been in power for more than two decades.

A similar trend was witnessed during the 2007 elections where Raila had more legislators supporting his second stab at the presidency than those who were supporting incumbent Mwai Kibaki but he still lost.

As a result, Miguna asked Raila not to start celebrations too early as they are likely to be disappointed.

“In 2002, Moi had more MPs than Kibaki but Kibaki defeated Uhuru who was Moi’s candidate. In 2007, Raila’s ODM had more MPs than Kibaki’s PNU but it was Kibaki who became president.”

“I’m cautioning Raila’s team to stop their usual premature celebrations,” Miguna said in a Tweet.

  • KeNHA Urges Motorists Plying Nairobi-Nakuru Highway To ‘Exercise Discipline’

The Kenya National Highways Authority (KeNHA) has implored motorists plying the Nairobi-Nakuru highway to exercise road courtesy to help ease vehicle influx on the route.

In a public notice issued on Friday, KeNHA underscored the congestion along the route and pleaded with motorists to exercise discipline to ease traffic flow.

“Motorists plying or planning to use the Nairobi-Nakuru highway are informed of the unusually high traffic along the highway,” said KeNHA.

“To enable traffic flow, motorists are advised to exercise discipline by avoiding overlapping.”

This comes after scenes witness for the better part of Friday morning which showed huge traffic snarl-ups on various major roads leading out of Nairobi as Kenyans made last-minute rushes to head for the Christmas festivities in their respective villages.

  • Newly-Launched Democratic Action Party To Back Raila In 2022 Polls

Leaders allied to the newly formed Democratic Action Party of Kenya (DAP-K) held a series of popularization rallies in Bungoma County on Thursday.

The leaders lashed out at Ford Kenya party leader Moses Wetangula for failing to unite the Luhya nation.

DAP-K party leader Wafula Wamunyinyi and Defence Cabinet Secretary Eugene Wamalwa rallied their supporters to throw their weight behind Orange Democratic Movement (ODM) party leader Raila Odinga and his Azimio la Umoja movement.

Wamalwa took a swipe at leaders opposed to his involvement in politics as a Cabinet Secretary.

“Tumekuwa kwa hiyo safari pamoja, tukafika mahali kwa sababu ya mahakama na ukora; dishonesty of the highest order. Nyinyi wenyewe mkauliza lazima tufanye uamuzi, tulifanya makosa kweli?” Posed Wamunyinyi, who is also the Kanduyi Member of Parliament.

“Tarehe 14 tukazindua hii chama iliyokuwa registered mwezi wa tano mwaka huu na vijana wetu hapa nyumbani, huyu ndugu yetu Eugene Wamalwa akiwa pia nyuma.”

CS Wamalwa, on his part, stated: “Leo nataka niseme kwa wale wanaosema ati Wamalwa anafanya siasa, I’m a political appointee wa Uhuru Kenyatta. Na kama rais ameona njia njema ni kujenga daraja ili nchi itulie, ni jukumu langu mimi nije hapa nyumbani tujenge hizo daraja.”

  • Two suspects in custody for forgery of logbooks

Two suspects will spend their Christmas holidays behind bars after the Makadara court ordered them to be detained for 7 days for forgery of logbooks and obtaining credit by fraud.

The duo, Timothy Mwangi and Peter Nyaga, were arrested after detectives discovered that one motor vehicle registration number and its logbook was registered to more than one vehicle.

Along with the discovery, the logbook was also discovered to have been used to secure loans from banks and microfinance institutions without the owner’s consent.

The owner of the said vehicle, Beatrice Kerubo, reported a case to the DCI claiming her husband was hijacked by a group of men along the Thika superhighway who demanded that he hands over the keys to the vehicle immediately.

The men, it later emerged, were auctioneers sent by a microfinance institution to impound the vehicle for defaulting on a loan.

He later inquired with his wife Kerubo whether she had secured a loan using the vehicle’s logbook, but she was equally shocked to learn that her logbook had been used to secure a loan yet she still had her original copy.

Upon probe, it was discovered that the two suspects had used a logbook under vehicle registration number KCU 244A illegally registered to a Toyota Harrier, to acquire credit of Ksh.876,000 from Avanzar Financial Solutions.  The car was genuinely registered to a Nissan Serena owned by Kerubo.

They also discovered that the two suspects had acquired over Ksh.4 million from MyCredit and Bidii Credit limited, using one logbook.

This was after Bidii Credit Limited advanced Ksh.2.1 Million to Timothy Mwangi on April 20, 2021, and before they collected the joint ownership logbook from NTSA, the logbook already had been transferred to someone else.

Further investigations into the case revealed that Mwangi’s accomplice had used the same logbook to secure a facility of Ksh.2.2 Million from MyCredit Limited on May 27, 2021.

Their arrest followed an expose by the DCI on how four other NTSA officials were suspected to be behind a criminal enterprise that alters vehicle logbooks and defrauds owners by changing ownership.

“Cybercrime experts based at the DCI headquarters have since joined their counterparts seconded to the National Transport and Safety Authority to smoke out the crooked officials at NTSA behind this high-level scam, that has left motorists worried that they could be driving vehicles already used as collateral to secure loans for shadowy individuals,” stated the DCI.

In the statement, DCI said Muthoni was transporting students from Nyeri to Nairobi for their mid-term break.

“After failing to contain the rowdy and highly intoxicated students, the driver resorted to driving them to the nearby police station. His selfless act landed him in trouble with the Sacco management and in the process, he was fired.

Kenyans protested online after he announced on Facebook that he had been fired from 2NK Sacco.

The responsible driver is now having the last laugh after he secured a job with Nyeri County Government.
